In accordance with paragraph 1 of Art. 28 of the Federal Law "On Military Duty and Military Service", a deferment from conscription for military service is granted by decision of the draft commission.

The grounds for granting a deferment are given in Article 24 of the Law “On Military Duty and Military Service”. In subparagraph "a" of paragraph 2 of the mentioned article of the law, students of general education institutions (gymnasiums, schools, etc.) have the right to a deferment until they reach 20 years of age.

Citizens studying in institutions of primary, secondary and higher education can also receive a deferment for a period not exceeding the standard period for mastering the curriculum. This deferment has no age limit and is granted no more than twice during the course of obtaining two levels of education.

A conscript has the right to a deferment during training if the following four conditions are simultaneously met:

1. He is studying at a state or municipal educational institution. If the educational institution is non-state, then the right to a deferment is only available if the institution has state accreditation.

2. He receives general (in schools, lyceums and other general educational institutions) or professional (in schools, technical schools, colleges, universities, postgraduate schools, residencies, postgraduate courses, etc.) education. At the same time, when receiving a general education, a citizen has the right to a deferment only until he reaches the age of 20, and when receiving a professional education (except for postgraduate education) - only for the period of validity of the standard deadlines for mastering basic educational programs.

3. He is studying full-time (and no other) way. In addition to students from educational institutions, a number of special bodies and services.

4. He did not exceed the limit of two deferments (the limit does not apply to those receiving postgraduate professional education and studying in educational institutions of some special bodies and services).

Schoolchildren who, for some reason, are “delayed” in a comprehensive school (or lyceum) until the age of 18, receive the first deferment already at school and can continue to study at this level for up to 20 years. In this case, they have only one deferment left to obtain further professional education.

Due to the increase in the spring conscription campaign, the General Staff advises 18-year-old school graduates to enroll in university before July 15, since military deferments do not apply to applicants.

However, some students still have a chance to avoid the army. As experts note, if an 18-year-old graduate used an “educational” deferment at school and manages to enter a university without joining the army, then he will have every right to a second deferment for studying at the university. This is clearly stated in paragraph 2 of Art. 24 of the Law "On Military Duty and Military Service".

As for the “gap” between finishing school and entering a university, during this period no deferments are in effect, and a criminal case can be brought against a young man for draft evasion (Article 328 of the Criminal Code of the Russian Federation).

However, if a young man still manages to enroll in a university before being convicted of evasion, then he will be exempt from criminal punishment “due to a change in the situation” - since he already has the right to a deferment. This is what the courts are recommended to do in the resolution of the plenum of the Supreme Court of the Russian Federation dated April 3, 2008.

To obtain an exemption from conscription for military service in accordance with Article 23 of the Federal Law “On Military Duty and Military Service,” the conscript must submit all the necessary documents confirming the right to be exempt from conscription (Sample applications: sample 1; sample 2).

It is important to know that a conscript will not be granted a deferment from conscription for military service until he is examined for health reasons. It is impossible to enroll in a university after college without completing military service, since this requires. In this case it is not provided. Various family circumstances

Despite the ambiguity of the concept of family circumstances, such an item in the above classification implies only a few very specific situations. When wondering how to avoid service, many draft dodgers try to motivate their goal with this very point. However, this also has its own nuances, so we will present all cases of granting an official deferment in the form of separate paragraphs.

  • Citizens who care for one of their close relatives are exempt from military service. These are considered brothers or sisters, parents, grandparents. Moreover, it is necessary that the conscript is the only one who is obliged to provide appropriate care, the need for care is documented (ITU conclusion), and the relative does not use state support.
  • Guardianship of a brother or sister who is under 18 years of age is subject to temporary release from service. Moreover, to obtain a deferment, it is necessary to provide documents proving that no one else except the conscript can be a guardian.
  • If a citizen is raising his own child, and the mother of this child is either absent (died or missing) or deprived of parental rights, then there is every reason for a delay, and in fact, for complete exemption from military service, since when the child reaches the age of majority, the citizen will cross the threshold of conscription age.
  • An only child in the family will not help to avoid the ranks of the Armed Forces, however, the birth of a second child or at least the established pregnancy of the wife, the period of which exceeds 25 weeks, is considered a good reason, and legalized. It is important to remember that a deferment for the birth of children is given even if the first child is born to a woman with whom the citizen is not married. As for pregnancy, the relationship with the woman must be legalized.
  • The only exception where temporary exemption may be granted if there is one child is if the child is declared disabled. This fact must be documented, and then until the age of three, the release will have legal force.

State of health and possibility of conscription

A mandatory procedure before military conscription is a meeting of the military commission. In addition to other activities, a medical examination of young men subject to conscription is provided. Guided by a government decree that regulates all activities of the draft commission, a decision is made on the citizen’s suitability for military service. At the same time, the question of who is granted only temporary release is being resolved.

The document that sets out all the selection criteria based on health conditions is called the “Schedule of Diseases.” It lists diseases and the degree of their complications, allowing one to determine the conscript’s fitness category. Temporary release for treatment or more detailed diagnosis of the disease corresponds to category “G”. There is no need to list all types of diseases, since a document in accessible form can be found dedicated to military service.

Civil service

If a citizen has a higher education obtained in the institutions of the Ministry of Internal Affairs, the FSB, the Ministry of Emergency Situations and is in service in the relevant bodies, as well as in structural units of the border service and the penal service, then during the specified period he is not subject to conscription.

Representatives of legislative power at the Federal and regional levels are also exempt from the ranks of the Armed Forces. These are deputies of the Federal Assembly and deputies of regional councils. The deferment of work is limited to the period for which the specified powers are valid. This also includes those local government positions that are elected rather than appointed.

There is a concept of “delay for 1 call”. It is used in relation to temporary exemption from military service, which is granted for the period of the conscription campaign. Its duration is short, but it is of particular value for those who enter universities, graduate school, or complete a medical examination, the results of which are provided to the military commissariat when a conscript claims to be declared unfit or partially fit for military service.

A deferment for one draft is in demand, but it is associated with so many complexities and discrepancies in existing legislation that young people and their parents prefer to turn to professional lawyers to put together a package of all kinds of documents on their own. There is no concept of deferment for 1 draft in the legislation, but only a list of grounds for temporary exemption from military service. But, knowing this list, a suitable reason for the delay can be found. The optimal reason is health status, and the supporting document for the reason for failure to appear at the draft board is a certificate of temporary disability.

But the problem is that military registration and enlistment offices often require a person to appear, even if he is sick. What to do in such a situation, since the document is provided only after discharge from the medical institution? Contact the prosecutor's office. The advice also applies to cases where a conscript is in serious condition or a close relative or adoptive parent has died. Cases when departments of the military registration and enlistment office break the law and “take away from the funeral” young people to serve in the Armed Forces are not uncommon.   • death certificate;
  • documents on kinship.

If the military commissariat ignores these grounds, it is better to immediately contact the prosecutor’s office. And one more nuance: along with disabled citizens and those whose close relative has died, a deferment for 1 conscription is provided to those who experience force majeure circumstances or have valid reasons. These formulations became the basis for all sorts of abuses of deferments from one draft.

For family reasons

The Law “On Military Duty and Military Service” clearly defines the list of grounds for temporary exemption from military service for family reasons. If a young man is caring for a disabled relative and the latter has no other relatives to take care of him, a deferment from the army for family reasons should be granted.

At first glance, this problem is quite simple to solve: the conscript presents documents on the degree of relationship and that the relative is disabled. Is there a deferment from the army if care is required for an adoptive parent? Yes. But the problem is different. Not all young people who have the right to receive temporary exemption from the “school of courage” have medical and social examination documents confirming that a relative is sick. The military registration and enlistment office will not take into account oral evidence or a certificate from the street committee. And in practice, it often turns out that a conscript is drafted to serve in the army, but at home he is left with an incapacitated relative with no one to care for him. There is only one conclusion here: submit the necessary documents to the ITU in a timely manner.

Who is temporarily exempt from military service?

The law provides for a deferment from the army due to the wife's pregnancy. But it is important to know that it clearly states the condition: the wife’s pregnancy must be at least 26 weeks. We must immediately take into account: the marriage must be officially registered. If the young people are common-law husband and wife, which is considered by modern Russian legislation as cohabitation, the young man will not receive exemption from the “school of courage”.

When a conscript has a child, there is no reason for deferment unless the circumstances are exceptional. Temporary exemption from military service is granted:

  • single fathers;
  • those who have two or more children;
  • if the conscript’s child is less than three years old;
  • when a citizen’s child is recognized by ITU as disabled.

Documents are required to confirm any of the above circumstances. It is important to know: the law also provides benefits to conscripts who are guardians or trustees of minors. This category of those liable for military service receives a temporary exemption from service in the RF Armed Forces not for six months, but until the time the ward becomes an adult.

School deferment

The first deferment from the army due to study is granted to schoolchildren who did not have time to complete their basic general education. It is given for the entire period of study at school, so the student cannot be called up for service, even if he is already 18 years old.

If a young man has reached conscription age before graduating from school, he has the right not only to complete his studies, but also, after receiving a certificate, to submit documents for admission to a university or college. Deferment from the army in 11th grade is given until October 1. If before this time the graduate does not enter a higher or secondary vocational educational institution, he will be able to be called up for service.

To receive a deferment, you need to provide the military registration and enlistment office with a certificate from your place of study. It must indicate the date, number of the order for enrollment in an educational institution, class and date of graduation.

The certificate must be:

  1. registered in the journal of official documents of the educational institution,
  2. signed by the director or deputy,
  3. confirmed by the seal of the educational institution.

Deferment from the army in college and technical school

On January 1, 2017, amendments to the Federal Law “On Military Duty and Military Service” came into force, concerning the provision of deferments to students of secondary specialized institutions. From this moment on, a deferment from the army after the 9th and 11th grades when entering a college, technical school or school is provided for the entire period of receiving education.

Conditions for obtaining a deferment from the army:

  1. To receive a deferment, the student must provide the military registration and enlistment office with a certificate from the place of study, application form No. 2. It must indicate the date and number of the enrollment order, the course of study and the date of graduation. The document is signed by the manager or deputy
    manager and certified by the seal.
  2. A college/technical school provides military deferment only if it has passed state accreditation.
  3. A deferment from the army from a technical school or college must be formalized at the military commissariat.

How to get a deferment from the army at a university (Bachelor's degree)

If a conscript is studying for a bachelor's degree, he also has the right to a deferment for the period of study. It is important to note that university students are not given a deferment from the army while studying by correspondence. Deferment from the army is guaranteed only to those students who are enrolled full-time. To apply for it, you need to get a certificate from the dean’s office confirming the fact of your studies. It should indicate:

How to get a deferment at a university (Master's degree)

According to the law, the magistracy gives a deferment from the army. Obtaining a deferment after a bachelor's degree is possible if three conditions are met:

  • the university/institute has passed state accreditation,
  • a master's student is studying full-time,
  • the student entered the master's program immediately after graduating from the bachelor's degree.
  1. Certificate form Appendix No. 2 confirming your studies at the university. It indicates the number and date of issue, the number of the enrollment order, the specialty code and the date of graduation from the university. The document must be signed by the rector or his deputy and have the university seal.
  2. A copy of the bachelor's diploma, certified by a notary or the university that issued the diploma.

Does the second master's degree give a deferment from the army? No, a graduate will not be able to obtain a second exemption from conscription. You can continue your studies only upon admission to graduate school.

During the period between completing a bachelor's degree and enrolling in a master's program, a student may be drafted into the army. Deferment after expulsion from the university

Obtaining a deferment after expulsion from a university has an important nuance. According to the federal law “On Military Duty and Military Service,” a conscript has the right to continue his studies, but only if:

  1. he left on his own initiative,
  2. The period of study after recovery did not increase.

A deferment for reinstatement after expulsion is not provided if the student was expelled on the initiative of the dean's office or rector's office due to academic failure. You will have to continue training after military service even if the conscript dropped out on his own initiative, but the period of training after reinstatement has increased by a year or longer.

Will they give a deferment again?

A draft deferment is given to a conscript once, but there are several exceptions to this rule. To determine whether a conscript can take advantage of another deferment, you need to pay attention to Article 24 of the federal law “On Military Duty and Military Service” and correctly determine the numbering of each paragraph.

  1. If a conscript has received a first deferment for entering a university after school, he can apply for a second one for undergraduate studies.
  2. If the conscript successfully passed the exams and in the same year received a deferment from the army for a master's degree (only after a bachelor's degree, specialists and masters do not have this right).
  3. If a conscript applies for a deferment from the army for a master's degree to enroll in graduate school.
  4. If a conscript was expelled from graduate school, but then re-entered, the deferment will be issued again.

The main criterion that allows you to use this right again and again is the continuity of the educational process. Students who move to a new level of education in the year they graduate from the previous one will not be drafted into the army. The second mandatory condition for obtaining a deferment is studying in an educational program that has state accreditation. If the program (or the educational institution as a whole) is not accredited, the inductee will not be granted a deferment. There is no deferment from the army for second higher education.

What to do with the army if you study abroad?

Military commissariats do not issue a deferment from the army for studying abroad, but this does not mean that a young man will not be able to obtain a higher education at a foreign university. The fact is that Russian citizens who live for a long time in the territory of another state are removed from military registration and are not called up for service.

If you are going to get an education abroad, you must appear at the district military registration and enlistment office, inform about your intention and write an application for deregistration. The application must be accompanied by evidence of moving abroad: documents on enrollment in a university, tickets, temporary residence permit and/or residence permit. Documents in a foreign language must have a notarized translation. After consideration and approval of the application, the conscript will be deregistered.

Distance learning abroad, if the conscript is in Russia, does not exempt you from conscription. In such cases, a deferment cannot be issued.
