It is no secret that some employers, instead of the usual five working days, establish a six-day working week for the team. For this reason, many are interested in a number of questions:

  • What are the standard hours per week with six working days;
  • How is processing paid?

  • How to calculate working hours;

The most common schedule options are either a 5-day work week or shift work (every three days). In both cases, you should be guided by the generally accepted standard of working hours per week - no more than 40 hours. The same applies to those who work on a “six-day” basis, and all hours that the employee worked above the norm must be paid at an increased rate, even if such schedule features were specified in advance in the employment contract.

Below we consider the situation when the employer is obliged to make additional payments for overtime work:

Nikanorova S.I. works in an organization where the work schedule is 6 days a week, day off is Sunday. Her working day lasts from 09:00. 00 min. until 5 p.m. 00 min. On Saturdays she works from 10 o'clock. 00 min. until 2 p.m. 00 min. Thus, she completes her weekly hours (40 hours) on Friday. Her work hours on Saturday are considered overtime, despite the fact that the organization’s local documents indicate the working hours.

In accordance with the Labor Code of the Russian Federation, she should be paid monthly additional payments for work above the norm, but the manager does not do this. Nikanorova S.I. appealed to the Trade Union with a complaint about the lack of additional payments, and after an inspection, the body determined that the actions of the manager Nikanorova S.I. are illegal.

Thus, all hours exceeding the weekly norm (40 hours) are overtime and are subject to mandatory compensation at a higher rate than scheduled work time on weekdays.

What regulatory documents and laws should employees working on a six-day week and employers planning to establish such a schedule be guided by:

  • “Production calendar for 2017”;
  • Art. 100 of the Labor Code of the Russian Federation on working hours;
  • Art. 91 of the Labor Code of the Russian Federation on normal working hours;
  • Art. 111 of the Labor Code of the Russian Federation on days off;
  • Art. 152 of the Labor Code of the Russian Federation on overtime work.

Is it possible to establish a six-day work week with one day off and how to do this?

The legislation does not make any prohibitions regarding the formation of work schedules in organizations: managers can establish both five-day or shift work schedules, as well as irregular work schedules. However, it should be remembered that, regardless of the schedule, there is only one standard working hours per week - 40 hours. The rest of the time worked on weekends is paid at double the rate.

To prevent errors in calculations, each company must keep a time sheet, which will indicate all employees and the days on which they worked or rested. At the end of the reporting period, this document is submitted to the accounting department, and on the basis of it, wages are calculated for each employee.

If the enterprise was organized only recently, then the working hours must be reflected in internal documents:

  • Collective agreement;
  • Employment contracts (when concluded with employees);
  • Internal labor regulations.

If an organization plans to switch from a five- to six-day work schedule, it will have to either re-sign employment contracts or draw up additional agreements to them. In any case, all documents must be properly executed and contain the necessary information, otherwise it will be considered a violation of labor laws.

Thus, when deciding to switch to a six-day work week, you need to consider several nuances:

  • Changes must be made only with the written consent of all employees (Article 72 of the Labor Code of the Russian Federation). The only exceptions are cases when it is impossible to maintain the previous work schedule due to technical or organizational reasons: then only a unilateral decision of the manager is sufficient (Article 74 of the Labor Code of the Russian Federation);
  • The employer is obliged to notify his subordinates no later than 2 months before the transfer to a new work mode, providing them with a notice to sign;
  • Additional agreements are concluded with employees who agree to the new schedule. Those who do not agree must be offered suitable available vacancies, and in their absence or refusal, employees are subject to dismissal under clause 7, part 1, art. 77 of the Labor Code of the Russian Federation, and they will have to pay severance pay equal to two weeks’ average earnings.

Important! The duration of continuous weekly rest should not be less than 42 hours with a six-day work schedule. Let's look at a correct example of creating a daily routine:

Davydova O.M. works as an accountant at a company. Her working days from Monday to Friday last from 08:00. 00 min. until 16 o'clock 00 min. On Saturday she works from 08:00. 00 min. until 12 o'clock 00 min. Thus, she has 44 hours left to rest until Monday, and the employer does not violate the law.

What if the organization has a five-day schedule, but employees periodically have to go to work on their days off? In this case, it is not necessary to draw up an additional agreement to the employment contract, because this is not a permanent mode of work, but overtime must be paid in any case. If desired, employees can use another option - ask their manager to provide time off, which is calculated at double the number of overtime hours.

How to calculate the standard working time for a six-day work week with one day off: rules

There should not be any particular difficulties in calculating here - just remember that all time exceeding 40 hours per week must be paid accordingly. For the calculation, you should use a working time sheet, and the maximum duration of overtime in one day cannot be more than 5 hours, even with additional payment. What could be an exception:

  • The employee remains to work in the organization on his day off for more than 5 hours on his own initiative;
  • Exceeding the overtime norm of 5 hours in one day off is caused by production necessity, but this must be documented in case of inspection.

If the organization has officially established a five-day workday, but the employee had to go on his day off, he can be compensated by time off based on his application, which must contain the following information:

  • Name of the enterprise, full name directors;
  • The bottom line: please provide another day of rest indicating a specific date for going to work on a day off (the date is also indicated);
  • Date of compilation and signature of the employee requesting time off.

In some organizations, there is a practice according to which, if overtime is systematically allowed, employees are given time off without their applications. This is permitted by law, but such a condition must be reflected in a collective or labor agreement, or in the internal regulations of the enterprise.

As for vacations, the general calculation procedure is used here, regardless of what daily routine is established in the company. Their duration does not depend on the number of hours worked and must be at least 28 calendar days. An exception is the category of employees who are granted additional leave: in this case, the duration of rest may be greater than the norm regulated by the Labor Code of the Russian Federation.

The most important nuance when establishing a six-day work week is the correct execution of all documents reflecting the work schedule. If an employee was initially employed on a five-day workday, and after some time he had to switch to a six-day workday, and the overtime is not paid, he has the right to complain to the Trade Union or the State Labor Safety Inspectorate, but collective complaints are most effective.

The standard working time for a six-day work week is calculated similarly to the calculated schedule of a five-day work week with two days off (Saturday and Sunday), based on the duration of the daily work shift.

Please note that the duration of a pre-holiday working day or shift must be reduced by one hour (Part 1 of Article 95 of the Labor Code of the Russian Federation). With a six-day working week on the eve of the weekend, the duration of work cannot exceed 5 hours (Part 3 of Article 95 of the Labor Code of the Russian Federation).

Reforming the education system affects almost all aspects of the lives of teachers and students, from the format of passing the Unified State Exam to the schedule according to which certain educational institutions operate. To be or not to be a six-day period? Psychologists, teachers and scientists have been working on this issue for many years, but this topic is even more actively discussed in parent circles. Will the six-day week be canceled in the near future?

It is known that there are several petitions that have collected a large number of signatures asking for a revision of the 6-day school schedule. But even in the 2019 academic year, the work schedule of each individual school, whether it will be five days or six days, will be decided directly by the management of the educational institution.

It seems to many that the ministry simply stubbornly refuses to satisfy the demands of parents who have come out to fight for an additional day off for schoolchildren.

But is it? Is it really possible to take one order and cancel working Saturdays for children and teachers forever? To understand the complexity of this problem, persistent parents would do well to study the legislation and curriculum better.

Why does the six-day period exist?

The need to use Saturday in most cases is dictated by the fact that even with a great desire, it is impossible to distribute educational subjects for students in grades 6-11 over 5 school days, if we take into account all the existing coefficients and sanitary requirements for the subjects.

Without delving into the intricacies of drawing up a schedule for a large educational institution, I will give the following standards as an example:

  • mathematics, physics, languages ​​and some other disciplines should not be assigned to the first and last lessons;
  • objects on which the child’s perseverance is especially important should not be placed after physical education;
  • Schoolchildren cannot be overloaded on one day (there are certain coefficients, the table of which is used by head teachers when drawing up schedules);
  • Subject teachers should not read more than 3 lessons in a row (this norm, of course, is often violated in our country);
  • subjects studied more than once a week should be placed at a certain interval.

This is only a small fraction of the existing restrictions. Add to this the division of classes into 2 (and sometimes 3-4) subgroups and you get an unsolvable problem. And this is not an exaggeration. Most automated scheduling services will really fail and ask which of the “important ministerial rules” can be ignored.

Pros of a six-day school week

  • Holidays that fall on Saturday are not postponed, as for organizations with a five-day work week.

The right to choose

This problem is not typical for all schools. As a rule, it does not fit into the five-day schedule in gymnasiums, lyceums and specialized schools with in-depth study of certain subjects.

As a result, parents have to choose between the following options:

  • A regular comprehensive school, in which the child will study for 5 days, but study all subjects at the “standard” level;
  • A specialized school or gymnasium with a 5-day period, where the child will have to sit through 8 lessons every day (and accordingly prepare homework);
  • An educational institution with in-depth study of certain subjects, in which the child will have 6-7 lessons a day, but 6 days a week.

You can and should find out what schedule awaits your child in the future at the stage of choosing a school. If high-quality competitive education is a priority, then the problem of working Saturday is not as pressing as the quality of the teaching staff and the conditions in which the child will study.

Of course, a new question arises - is it possible, by adding hours for specialized subjects in specialized schools, to reduce the hours for disciplines that children who have decided on a profile will definitely not need? But this is a completely different topic that requires a revision of the list of subjects in the variable and invariable components of domestic education.

The scope of activity of a number of enterprises (organizations) requires the establishment of a six-day working week.

The presented work schedule is due to the need to provide services provided by companies outside the standard five-day work schedule.

The involvement of workers in the execution of production tasks 6 days a week is carried out in accordance with the norms and restrictions presented by the legislator.

The 6-day week is put into effect at the discretion of the organization’s management, which also determines labor standards in the appropriate operating mode.

What is this according to the Labor Code of the Russian Federation?

Taking into account the specifics of production in legal entities of all forms of ownership, the following operating modes can be established:

  • six-day week;
  • shift work.

Labor legislation establishes a general standard work schedule, which is 40 hours a week with 5 working days and 2 days off.

In this case, days off may be:

  • combined (Sunday + Saturday or Monday);
  • floating (Sunday + any day of the week).

Important! Sunday, regardless of operating hours, is considered a day off.

A six-day week is a work pattern in which workers have one day off per week, subject to a maximum of 40 working hours.

The exact concept of the presented term is not fixed in the Labor Code, however, the legislator puts forward basic requirements that must be present in any working hours:

  • length of the working week;
  • temporary indications of arrival at work, end of the working day, and breaks;
  • weekend.

Is it legal to install?

With a five-day schedule, daily working hours are usually 8 hours.

For workers involved in production for six working days, an additional rule has been established that it is impossible to establish working hours on the eve of holidays and weekends that exceed 5 hours.

Taking into account the above prohibition, employers most often use the following six-day work schedule:

  • from Monday to Friday the duration of work is 7 hours daily;
  • Saturday – 5 o’clock.

Important! The legislator does not establish restrictions on the use of other schedule schemes, the use of which takes into account the restrictions of the Labor Code.

How are timesheets kept?

It was indicated above that when using a six-day working week in an enterprise (organization), total records of working time should be kept.

Those. all legal entities with a standard, five-day week, when calculating hours worked and calculating wages, use the formulas presented by Regulation No. 588 n, however, similar calculations are not suitable for companies with 6 working days due to the unequal number of Saturdays in each month.

The management of the company appoints a responsible person who is obliged to conduct.

To accurately calculate wages, the accounting document is filled out in a combined way - using letter designations, as well as indicating the daily number of hours worked by employees.

As a rule, with a six-day period, a weekly accounting period is established, i.e. at the end of each working week, the authorized employee sums up the number of hours worked by the workers and enters the resulting amount in the designated cells.

At the end of the month, all weekly indicators that directly affect payroll are summed up.

The procedure for establishing a 6-day week and the transition from a five-day week

The working hours, which include a six-day or five-day schedule, are an essential working condition that every employee must be familiar with before signing an employment contract.

The specified routine is necessarily fixed in the local acts of the enterprise - the collective labor agreement and the internal labor regulations.

Due to changes in production, it may be necessary to change the work schedule from a five-day to a six-day work week.

The submitted changes are formalized by issuing an order by the head of the organization in accordance with the regulated procedure.

The order, as well as the new schedule and internal labor regulations, must be developed no later than 2 months before the innovation comes into force.

After the order is issued, it should be familiarized with it against signature of each employee who gives written consent to work under the updated regime or refuse to switch to a six-day regime with further termination of the employment contract.

Due to the fact that the amendments may entail mass layoffs, the employment service is notified of the transition to a six-day schedule.

An additional agreement to the employment contract is signed with employees who give written consent to work according to the new schedule.

The order to switch to a six-day working week is issued in accordance with the basic requirements of office work.

The submitted document must specify the reason why production is forced to increase the number of working days, and also specify the daily number of working days, days off, and break time.

The specified administrative document is signed by the manager, as well as by officials who are directly affected by the order (on familiarization of employees, on concluding additional agreements, on new payroll calculations, etc.).

The legislator allows the establishment of a six-day working week in enterprises (organizations), the specifics of which do not allow production tasks to be completed in only five working days.

In the presented companies, a restriction regarding the maximum number of working hours per week is observed, and wages are calculated in accordance with the total recording of working hours.

The transition from 5 working days to 6 is carried out by issuing a corresponding order, notifying employees and concluding additional agreements with the latter.

Non-working holidays in Russia are (Article 112 of the Labor Code of the Russian Federation):

By Decree of the Government of the Russian Federation dated October 14, 2017 No. 1250, the following days off were postponed in 2018:

  • Saturday January 6 to Friday March 9 (for a six-day period this transfer does not matter - March 9 will be a regular working day);
  • Sunday 7 January to Wednesday 2 May.

The Government also moved the weekend from Saturdays April 28, June 9 and December 29 to Mondays April 30, June 11 and December 31, respectively. However, with a six-day work week, Saturdays are not days off, which means that these transfers are not provided for a six-day work week.
